1. Acceptance of Terms

By accessing or using Tonsofpros website ("the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Tonsofpros is a platform that connects service requesters (customers) with qualified professionals (contractors, tradespeople, and service providers). We facilitate introductions but are not a party to any service agreement between users and professionals.

3. User Accounts

3.1 Registration

To use certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Professional Accounts

Professionals creating accounts must provide valid business information, including but not limited to: business name, contact information, service areas, and professional licenses where applicable. Tonsofpros reserves the right to verify professional credentials.

4. User Conduct

You agree not to:

  • Violate any laws, regulations, or third-party rights
  • Post false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Upload malicious code or interfere with the Service's operation
  • Harass, abuse, or harm other users
  • Use the Service for any unauthorized commercial purpose
  • Circumvent or attempt to circumvent any fees or payment obligations

5. Job Postings and Bids

5.1 For Service Requesters

When posting a job, you agree to provide accurate descriptions of the work needed. You understand that professionals are independent contractors and not employees of Tonsofpros.

5.2 For Professionals

When bidding on jobs, you agree to provide accurate quotes and timelines. You are solely responsible for the quality and completion of any work you agree to perform. Professionals must maintain appropriate licenses, insurance, and permits as required by law.

6. Payments and Fees

6.1 Service Fees

Tonsofpros may charge fees for certain services, including but not limited to: job posting fees, lead fees, subscription fees for professionals, and transaction fees. All fees will be disclosed before you incur them.

6.2 Payment Processing

Payments are processed through third-party payment processors. You agree to provide accurate payment information and authorize us to charge applicable fees to your selected payment method.

6.3 Refund Policy

Refunds are handled on a case-by-case basis. Generally, fees for completed services (job postings, lead connections) are non-refundable. Subscription fees may be prorated upon cancellation. Contact support@tonsofpros.com for refund requests.

7. Professional Requirements

Professionals using Tonsofpros represent and warrant that they:

  • Hold all necessary business licenses and permits
  • Carry appropriate liability insurance
  • Comply with all applicable laws and regulations
  • Will perform services in a professional and workmanlike manner
  • Will not subcontract work without customer consent
  • Will honor quoted prices and timelines

8. Intellectual Property

8.1 Our Content

The Service and its original content, features, and functionality are owned by Tonsofpros and are protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

By uploading content (photos, descriptions, reviews) to the Service, you grant Tonsofpros a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with providing the Service.

9. Reviews and Ratings

Users may leave reviews and ratings for professionals. Reviews must be truthful and based on actual experiences. Tonsofpros reserves the right to remove reviews that are fraudulent, defamatory, or violate these terms. Professionals may respond to reviews but may not offer incentives for positive reviews.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TONSOFPROS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF ANY PROFESSIONAL OR SERVICE REQUESTER. YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TONSOFPROS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR USE OR INABILITY TO USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY SERVICES OBTAINED THROUGH THE SERVICE; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL TONSOFPROS'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO TONSOFPROS, IF ANY, IN THE PAST 12 MONTHS.

12. Indemnification

You agree to defend, indemnify, and hold harmless Tonsofpros and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal fees, arising out of or in any way connected with (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any third-party rights; or (iv) any services you provide or receive through the Service.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by the laws of the State of New Mexico, without regard to its conflict of law provisions.

14.2 Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in Albuquerque, New Mexico, except that either party may seek injunctive relief in court to protect intellectual property rights.

14.3 Small Claims

Either party may bring an individual action in small claims court instead of arbitration, provided the claim qualifies.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

16. Professional Account Terms

Professionals with active accounts may access their dashboard to manage services, upload portfolio images, set service areas, and respond to job postings. Tonsofpros reserves the right to verify professional credentials and may suspend accounts that violate these Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and Tonsofpros regarding the Service and supersede any prior agreements.
